Tennis Time Terms of Use

These terms govern your use of the Tennis Time apps for Apple Watch and iPhone (the "App"). By installing or using the App you agree to them. If you do not agree, do not use the App. Apple's standard Licensed Application End User License Agreement also applies to the extent these terms do not say otherwise; where they conflict, these terms prevail between you and us.

1. What the App is, and is not

Tennis Time keeps the score of a tennis match on your wrist and, with your permission, shows heart rate and calories from Apple Health. It is a scoring and convenience tool. It is not a medical device, a fitness coach, a health service or a referee, and nothing it shows is medical, health, training or safety advice.

2. Playing sport is your responsibility

• Assumption of risk. Tennis and physical exercise carry a risk of injury, including serious injury, from falls, collisions, overexertion, heat, equipment, the court and other players. You take part in any sport, warm-up or physical activity at your own risk and by your own decision. The App does not make any activity safer and does not watch over you.
• Your condition. Consult a doctor before starting or changing physical activity, especially if you have a heart condition, high blood pressure, are pregnant, take medication, or have not exercised regularly. Stop immediately and seek medical help if you feel unwell.
• Heart-rate and calorie figures come from Apple Health and the sensors of your watch. They are estimates; they may be delayed, inaccurate, incomplete or missing, and the heart-rate zones are a generic formula based on age. Never rely on them to judge your health, your safety or how hard you can push. The App does not detect or warn of any medical condition.
• Hands-free gestures use the watch's motion sensors and can misread a swing or a gesture. Do not perform gestures in a way that endangers you or others, and do not let the App distract you from the ball, your partner or your surroundings. Look at the watch only when it is safe to do so.
• The court, equipment and other people are entirely outside the App and outside our responsibility.

3. Scores and records

The App records what you (or the other watch in a shared match) enter. We make no promise that any score, record, statistic, ranking, duration, calorie count or heart-rate figure is correct, complete or preserved. Points can be entered wrongly, undone, lost in a sync, or lost if a device, iCloud or Apple Health fails. Statistics and rankings are for fun. Keep your own record of anything that matters to you. The App is not an arbiter of any dispute between players.

4. Sharing a match and connecting a friend

When you share a match, you publish the players' names and the score to a copy that anyone with the code can read while the sharing lasts. When you connect a friend, you publish the players' names and the score of every match you record with that friend to a copy that anyone with the link can read until you disconnect, and the friend's phone keeps its own copies of those matches, which are theirs. You are responsible for whom you give the code or the link to, and you confirm you have the agreement of the people whose names appear. We are not responsible for what another participant enters, changes, keeps or does with a shared match or a connection.

5. Subscriptions and purchases

• Pro is sold through Apple's App Store as an auto-renewable yearly subscription or a one-time lifetime purchase. Prices are shown in the App before you buy and may differ by country.
• The yearly subscription renews automatically at the price shown unless you cancel at least 24 hours before the end of the current period. You manage or cancel it in your Apple ID subscription settings; deleting the App does not cancel it.
• The App offers a free trial of Pro features that the App itself keeps time of (currently 10 days from your first completed match). It is a courtesy, not a right: its length, contents and availability may change, and it may not be available again after a reinstall or on another device.
• Payments, refunds and billing disputes are handled by Apple under Apple's terms; we cannot issue refunds ourselves.
• Pro features depend on Apple services (the App Store, iCloud, CloudKit) that we do not control; a feature may be unavailable while such a service is.

6. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable licence to use the App on Apple devices you own or control, under Apple's usage rules. You may not copy, modify, reverse engineer, redistribute, sell or rent the App, or use it in a way that is unlawful, harms others, or interferes with Apple's services or with other users (for example, by guessing share codes or connection links to reach matches you were not invited to).

7. Your data

Our Privacy Policy explains what the App handles and where it is kept. In short: your data stays on your devices and in your own iCloud, apart from the copies you share or connect, which exist while the sharing or the connection lasts; we hold nothing else and cannot recover your data for you. Back up your devices as you see fit.

8. No warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that the App will meet your needs, that scores or figures will be correct, or that data will not be lost.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEBECY, ITS OWNERS, EMPLOYEES AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, LOSS OR DAMAGE OF ANY KIND, WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, INCLUDING PERSONAL INJURY, HEALTH CONSEQUENCES, LOST DATA, LOST SCORES OR RECORDS, LOSS OF PROFITS OR OF ENJOYMENT, ARISING OUT OF OR IN CONNECTION WITH THE APP, ITS FIGURES, ITS GESTURE RECOGNITION, A SHARED MATCH, APPLE HEALTH, ICLOUD OR ANY SPORT OR ACTIVITY YOU TAKE PART IN WHILE USING OR AFTER USING THE APP, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain exclusions; in those, our liability is limited to the smallest extent the law allows, and nothing here limits liability that cannot lawfully be limited.

10. Indemnity

You agree to hold us harmless from claims by third parties (including other players and people whose names you enter or share) arising from your use of the App in breach of these terms or of the law.

11. Apple

Apple is not a party to these terms, has no obligation to provide maintenance or support for the App, and is not responsible for any claim relating to the App, including product liability, legal or regulatory compliance and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes and termination

We may change the App or these terms; the effective date above shows the current version and continued use after a change is acceptance of it. We may stop offering the App or any feature at any time. You may stop using the App at any time by deleting it; an active subscription is cancelled in your Apple ID settings.

13. Governing law and disputes

These terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and the competent courts of Tel Aviv-Jaffa have exclusive jurisdiction, except where the consumer-protection law of your country of residence gives you rights or a forum that cannot be waived, in which case those apply. If any part of these terms is held invalid, the rest remains in force.
